PROMOTION OF ACCESS TO INFORMATION ACT (PAIA) MANUAL

Prepared in accordance with:
The Promotion of Access to Information Act, 2 of 2000 (“PAIA”) gives effect to the constitutional right of access to information held by public and private bodies, subject to justifiable limitations.
This PAIA Manual is compiled in accordance with Section 14 of PAIA, as prescribed for public bodies, and follows the Information Regulator’s latest PAIA Manual template.
The C P Nel Museum is committed to transparency, accountability, and good governance, while ensuring that personal and confidential information is protected in accordance with PAIA and POPIA.

The C P Nel Museum processes personal information in accordance with the Protection of Personal Information Act, 4 of 2013 (POPIA).
Personal information processed by the Museum may relate to:
Employees and former employees
Board and committee members
Donors, benefactors, and sponsors
Volunteers and interns
Service providers and contractors
The Museum undertakes to:
Process personal information lawfully, fairly, and transparently
Collect personal information for specific, explicitly defined, and lawful purposes
Retain personal information only for as long as necessary
Implement appropriate technical and organisational safeguards to prevent loss, damage, or unauthorised access
Withholding of Personal Information
In accordance with PAIA and POPIA:
Personal information of any employee, board member, benefactor, donor, volunteer, or service provider will be withheld unless disclosure is required by law or the written consent of the data subject has been obtained.
Access to records may be refused in terms of Chapter 4 of PAIA where disclosure would:
Result in the unreasonable disclosure of personal information
Endanger the life or physical safety of an individual
Prejudice the security or property of the Museum
Reveal confidential commercial, financial, or donor-related information
Breach a duty of confidentiality imposed by agreement or legislation
A requester seeking access to a record must complete the prescribed Form 2 (Request for Access to Record) and submit it to the Information Officer.
Requests must:
Be made on the prescribed form
Contain sufficient detail to identify the record requested
Indicate the preferred form of access
The Information Officer will process the request within the timeframes prescribed by PAIA.
Request Fee
In terms of the PAIA Regulations, a request fee of R50.00 (fifty rand) is payable for each request submitted to the C P Nel Museum, where applicable. The request will only be processed once proof of payment of the request fee has been received.
The Information Officer will inform the requester if any additional access or reproduction fees are payable, as prescribed by PAIA.
The Information Officer will process the request within the timeframes prescribed by PAIA
A requester who is dissatisfied with a decision of the Information Officer may:
Lodge an internal appeal where applicable; or
Submit a complaint to the Information Regulator; or
Apply to a court of competent jurisdiction for relief
